The Attorney General had exercised her power to refer a devolution issue to the Supreme Court for its consideration. The judgment, which clarifies the interpretation of Article 5 of the European Convention on Human Rights, is welcome.
Speaking today, the Attorney, Dame Brenda King commented:
“I am grateful for the extensive engagement by everyone involved in the proceedings before the Supreme Court. I welcome its authoritative ruling which will assist all of us who are concerned with the protection of rights and implementation of mental capacity legislation.”
